            <description>&lt;br /&gt;&lt;br /&gt;CIMB countersues 12 over duplicate credit error, demands RM1.39mil&lt;br /&gt;Predeep Nambiar -April 2, 2022 7:00 PM&lt;br /&gt;2.7k&lt;br /&gt;Shares&lt;br /&gt;facebook sharing buttontwitter sharing buttonwhatsapp sharing buttonemail sharing button&lt;br /&gt;&lt;br /&gt;CIMB has claimed that a processing error by a remittance service led to fund transfers made to customers being wrongly credited twice.&lt;br /&gt;GEORGE TOWN: CIMB has countersued 12 parties suing the bank over what it described as “unjust enrichment” stemming from a processing error that left their accounts frozen and in debt.&lt;br /&gt;&lt;br /&gt;In a court filing on March 30, the bank also asked for an order for all 12 to repay RM1.39 million wrongly credited into their accounts, plus interest.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;In February, CIMB claimed a processing error by a remittance service led to fund transfers made to customers being wrongly credited twice.&lt;br /&gt;&lt;br /&gt;The bank earmarked affected accounts to recover the duplicate sums, which led to accounts being frozen.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Then, on Feb 28, 12 affected account holders filed a suit against the bank for the error as they felt it was the bank’s fault, not the customers.&lt;br /&gt;&lt;br /&gt;In a statement of defence sighted by FMT, CIMB said it had not violated any contract with its account holders as they were free to debit or put on hold any account as they wished — as it was part of the terms and conditions agreed to by the bank users.&lt;br /&gt;&lt;br /&gt;Hence, in January, the bank said an “operational hold” had been placed on affected accounts. It was later lifted on Feb 13. However, it did not say how many accounts were affected.&lt;br /&gt;&lt;br /&gt;CIMB said as a result of the duplicate credits, the account holders had been “unjustly enriched” at the bank’s expense.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The bank said the 12 suing parties did not alert them when additional, duplicate funds were transferred into their accounts.&lt;br /&gt;&lt;br /&gt;CIMB said it was allowed to recover the duplicate sum as it was legally and contractually entitled to.&lt;br /&gt;&lt;br /&gt;“The plaintiffs were able to receive funds in their respective accounts and/or make withdrawal of funds in excess of the amount of the duplicate credits received by each plaintiff.&lt;br /&gt;&lt;br /&gt;“The plaintiffs have received and enjoyed, and have been enriched by way of the duplicate credits that were mistakenly credited into the plaintiffs’ accounts by reason of the inadvertent processing error of MoneySend transfers as pleaded,” the defence statement read.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;FMT has contacted MasterCard, which provides the MoneySend service for comment.&lt;br /&gt;&lt;br /&gt;Those suing are: Ahmad Sharil Nor Rasit, 42, Azwani Aziz, 39, Nor Amirah Suria, 26, Nor Sazliana Sazali, 31, Mukmin Mohd Ibrahim, 34, Siti Roziana Abdullah, 26, Haris Fadhillah Yaacob, 28, Azizi Aziz, 34, Azizul Aziz, 40, and three companies — Ai Smart Perfect Services, Ai Smart PS Trade and Harmonian Altra Trading.&lt;br /&gt;&lt;br /&gt;CIMB Bank Bhd and CIMB Islamic Bank Bhd are named as defendants in the suit.&lt;br /&gt;&lt;br /&gt;The bank had said the problem involved “a limited number of customers that undertook international to local transfers”, and pledged to offer a fair and managed resolution to affected customers.</description>

Do you think employers will hire workers like that? Every little thing is uploaded on social media these days,” she wrote.&lt;br /&gt;&lt;br /&gt;Defending the lecturer, Hidayah felt that Roshana did not insult the B40 group but had only used a rude tone because she was disappointed with the particular student’s attitude.&lt;br /&gt;&lt;br /&gt;“In my opinion, the professor was angry because the student did not have a computer although he was already in semester five. Yes, people are struggling but as a student, he should be responsible too.&lt;br /&gt;&lt;br /&gt;“I also had lecturers that I did not like but I did not embarrass them in public. Being a lecturer, of course she had to scold the student who she felt was not serious about his studies,” she said.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Hidayah said many B40 children are very successful and have shown motivation to achieve their dreams.&lt;br /&gt;&lt;br /&gt;“Many students who have lost their parents at a young age have also studied hard and become successful. And there are those who work part-time to be able to afford a laptop.&lt;br /&gt;&lt;br /&gt;“There are also NGOs, government agencies and elected representatives, among others, who help buy computers for those who cannot afford it,” she said.&lt;br /&gt;&lt;br /&gt;Earlier today, netizens criticised the lecturer’s action after a video of her admonishing the student for not having a computer during the online lecture went viral.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;She said she did not like to teach students from the B40 category as they did not seem to show interest in their studies.&lt;br /&gt;&lt;br /&gt;“If you have a sister and she has a gold bracelet, tell her to sell that and buy you a computer. He further said there was no crime committed or conflict of interest in the matter.&lt;br /&gt;&lt;br /&gt;“We categorically wish to state that the board members at that meeting or at any time thereafter did not express such opinion as Abu Zahar attributed to,” they said in a statement.&lt;br /&gt;&lt;br /&gt;They also said that the members of the board had a separate discussion with Abu Zahar prior to the press conference.&lt;br /&gt;&lt;br /&gt;“We proposed that the matter be further referred to any of the following panels and committees, namely the Independent Committee, the Parliamentary Special Committee on Corruption or MACC’s Complaints Panel,” they said.&lt;br /&gt;&lt;br /&gt;However, the six said that their views and proposals were not raised during Abu Zahar’s press conference.&lt;br /&gt;&lt;br /&gt;“The ACAB has no investigation power as it is established as an Advisory Board.&lt;br /&gt;&lt;br /&gt;“We need to provide this clarification in order to safeguard the integrity of the board and the institution,” they said.&lt;br /&gt;&lt;br /&gt;Over the past month, reports emerged alleging that Azam owned a substantial amount of shares in several publicly-listed companies.&lt;br /&gt;&lt;br /&gt;Azam, in a press conference on Wednesday, said he had explained to the ACAB that his share account had been used by his brother to buy stocks in the open market with the latter’s own financing. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;</description>

            <description>On-trial Zahid asks court to return passport so he can go to Germany to treat neck, back pain&lt;br /&gt;Thursday, 07 Oct 2021 11:12 AM MYT&lt;br /&gt;&lt;br /&gt;BY IDA LIM&lt;br /&gt;&lt;br /&gt;KUALA LUMPUR, Oct 7 ― Former deputy prime minister Datuk Seri Ahmad Zahid Hamidi is seeking the temporary release of his impounded passport so he can travel to Germany for medical treatment.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;His lawyer Hamidi Mohd Noh made the application in the High Court here today, saying his client needed to be treated for his pain from a leading specialist in Munich, Germany&lt;br /&gt;&lt;br /&gt;“Because the accused has been suffering from back pain and neck pain from before&lt;br /&gt;&lt;br /&gt;“We are making this application to allow the accused treatment to the effect where it is effective and that is required,” he said, adding that the current pain treatment available in Malaysia was not enough for Ahmad Zahid.&lt;br /&gt;&lt;br /&gt;&lt;a href='https://www.malaymail.com/news/malaysia/202...o-treat/2011447' target='_blank'&gt;https://www.malaymail.com/news/malaysia/202...o-treat/2011447&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;He noted that Ahmad Zahid has been treated around 2013, 2014 and 2016 for such pain, saying: “And the current regime of pain intervention in Malaysia is not sufficient for him, he’s still suffering a lot, and as Yang Arif has already heard from the doctor treating him here, that the pain is not manageable and that he requires certain intervention by his consulting physician.”&lt;br /&gt;&lt;br /&gt;The application was filed on October 4, and came up for case management today.&lt;br /&gt;&lt;br /&gt;Deputy public prosecutor Gan Peng Kun told the court that “the prosecution has instructions not to object to the application”.&lt;br /&gt;&lt;br /&gt;Judge Datuk Collin Lawrence Sequerah said he would make an order on this application next Monday.&lt;br /&gt;&lt;br /&gt;Sequerah is also the trial judge presiding over Ahmad Zahid’s 47-criminal charge case, and is expected to continue hearing arguments from the prosecution on Monday on why Ahmad Zahid should be called to enter his defence over the criminal charges.&lt;br /&gt;&lt;br /&gt;The 47 charges that Ahmad Zahid is facing here are 12 counts of criminal breach of trust in relation to charitable foundation Yayasan Akalbudi’s funds, 27 counts of money-laundering, and eight counts of bribery charges.&lt;br /&gt;&lt;br /&gt;Hamidi told the court that a similar application for passport release has also been made to the High Court in Shah Alam, where Ahmad Zahid is facing a separate corruption trial involving 40 charges.&lt;br /&gt;&lt;br /&gt;Ahmad Zahid’s lawyers will be going to the High Court in Shah Alam first on Monday morning for the passport release application there, before coming to the High Court in Kuala Lumpur on Monday afternoon for the passport release application and the continued hearing for the trial.&lt;br /&gt;&lt;br /&gt;Later when asked by reporters, Hamidi confirmed that the application is for the passport to be released on October 26, and to be returned on November 21.&lt;br /&gt;&lt;br /&gt;Previously, Ahmad Zahid was said to have suffered a fall on August 18, and was admitted to a private hospital on August 22 due to injuries from the fall and was discharged on August 26. He was also on medical leave until September 4.&lt;br /&gt;&lt;br /&gt;On August 24 which was when Ahmad Zahid’s trial in the High Court in Kuala Lumpur was scheduled to continue, he was not present in court, with his lawyer explaining that he could not attend due to severe neck pain and could not sit for a long time.&lt;br /&gt;&lt;br /&gt;Ahmad Zahid’s doctor later told the court that his client had on August 24 undergone treatment for his pain and disagreed that his client had faked his illness to avoid attending court.&lt;br /&gt;&lt;br /&gt;Ahmad Zahid’s passport had been surrendered to the courts since he was first charged in October 2018.&lt;br /&gt;&lt;br /&gt;Back in 2019, Ahmad Zahid had also applied to the court for the temporary return of his passport to enable him to travel to Saudi Arabia between May 9 and June 3 to perform umrah or for a Muslim pilgrimage trip.&lt;br /&gt;&lt;br /&gt;But the High Court on May 3, 2019 had rejected the application then as such a trip was not compulsory and as Ahmad Zahid was facing serious charges in the trial, with the Court of Appeal on May 14, 2019 and the Federal Court on May 23, 2019 also dismissing his appeals against the High Court’s decision.</description>
