            <title>ICERD Does Not Violate the Federal Constitution</title>

            <description>The Malaysian Bar welcomes Prime Minister Tun Dr Mahathir Mohamad’s statement, made on 28 September 2018 during the 73rd United Nations General Assembly, that “the new government of Malaysia has pledged to ratify all remaining core UN instruments related to the protection of human rights”.  We are further encouraged by the reiteration of the Government’s commitment to accede to the remaining six core international human rights instruments, made by Foreign Ministry Secretary-General Dato’ Seri Ramlan Ibrahim when speaking at Malaysia’s Universal Periodic Review (“UPR”) at the United Nations in Geneva, Switzerland on 8 November 2018.&lt;br /&gt;&lt;br /&gt;One of the six core instruments that Malaysia has yet to accede to is the International Convention on the Elimination of All Forms of Racial Discrimination (“ICERD”), which was adopted and opened for signature and ratification on 21 December 1965, and entered into force on 4 January 1969. &lt;br /&gt;&lt;br /&gt;There are already 179 countries that are States Parties to ICERD, and four countries are signatories.  Malaysia stands with the very small minority of 14 countries that have yet to act on ICERD, which include Myanmar, South Sudan, and the Democratic People’s Republic of Korea. &lt;br /&gt;&lt;br /&gt;Since the announcement, there has been vocal opposition by certain parties to the Government’s intention to accede to ICERD.  The critics’ primary objection is that accession to ICERD would offend Article 153 of the Federal Constitution, which enjoins the Yang di-Pertuan Agong to “safeguard the special position of the Malays and natives of any of the States of Sabah and Sarawak and the legitimate interests of other communities”. &lt;br /&gt;&lt;br /&gt;Article 1(4) of ICERD — which provides that “special measures” (including affirmative action) are permissible — states as follows:&lt;br /&gt;&lt;br /&gt;    Special measures taken for the sole purpose of securing adequate advancement of certain racial or ethnic groups or individuals requiring such protection as may be necessary in order to ensure such groups or individuals equal enjoyment or exercise of human rights and fundamental freedoms &lt;b&gt;shall not be deemed racial discrimination&lt;/b&gt;, provided, however, that such measures do not, as a consequence, lead to the maintenance of separate rights for different racial groups and that they shall not be continued after the objectives for which they were taken have been achieved. [emphasis added]&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;This principle is reinforced in Article 2(2), which provides as follows:&lt;br /&gt;&lt;br /&gt;    States Parties shall, when the circumstances so warrant, take, in the social, economic, cultural and other fields, special and concrete measures to ensure the adequate development and protection of certain racial groups or individuals belonging to them, for the purpose of guaranteeing them the full and equal enjoyment of human rights and fundamental freedoms.  These measures shall in no case entail as a consequence the maintenance of unequal or separate rights for different racial groups after the objectives for which they were taken have been achieved.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;It is clear from the above provisions that ICERD recognises that formal equality — where the law treats people the same — may not be sufficient to eliminate discrimination.  ICERD seeks to bring about effective or substantive equality, including through temporary special measures, where required.  These principles are elaborated upon in General Recommendation 32 issued by the Committee on the Elimination of Racial Discrimination, which spells out the meaning and scope of “special measures”.&lt;br /&gt;&lt;br /&gt;There is thus no contradiction between ICERD and Article 153 of the Federal Constitution. &lt;br /&gt;&lt;br /&gt;The Malaysian Bar holds the view that it is time Malaysia acknowledges the inherent dignity and equality of all human persons irrespective of race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status.             <title>Malaysia: Additional rabies case reported</title>

On August 11, 2018, he was hospitalized at Serian Hospital for fever and shortness of breath. In the ward, patients show signs of hydrophobia and weakness. The patient was then referred to the Sarawak General Hospital on August 14, 2018. He is currently treated at the Infectious Disease Ward and is in critical condition.&lt;br /&gt;&lt;br /&gt;The pet dog died a week after the bite. However, no confirmation can be made for the cause of the dog’s death.&lt;br /&gt;&lt;br /&gt;The dog bit a resident of the same village in January 2018. The bite has been identified and has been given an anti-rabies vaccine on August 16, 2018.             <description>The &lt;b&gt;Malaysian Bar welcomes the statement by Deputy Prime Minister Dato&amp;#39; Seri Dr Wan Azizah Wan Ismail that the marriage between a 41-year old man and a 11-year old girl is unlawful, and that it is time to increase the age limit of marriage involving girls from 16 to 18.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;The Malaysian Bar looks forward to the government instituting law reform in this regard, and for the government to take proactive steps and measures &lt;b&gt;to increase public awareness of the detrimental effects of marriage upon a child’s physical and mental health, education and economic opportunities, and risk exposure to domestic and sexual abuse.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;The government bears a critical obligation and duty to ensure the healthy development and protection of all children in Malaysia, pursuant to Malaysia’s accession of the United Nations Convention on the Rights of the Child (“CRC”).  According to the Child Act 2001, which was enacted to fulfil Malaysia’s obligations under the CRC, a child is defined as a person under the age of 18 years. &lt;br /&gt;&lt;br /&gt;However, the &lt;b&gt;Law Reform (Marriage and Divorce) Act 1976 stipulates that the marriage of non-Muslim children below 16 years old cannot be legally approved.             <title>Abuse of Police Investigative and Detentive Powers</title>

            <description>Abuse of Police Investigative and Detentive Powers Must Stop &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The Malaysian Bar is appalled and outraged that Siti Zabedah Kasim (“Siti Kasim”) was arrested and detained during the early hours of 24 June 2018 for purportedly kidnapping her client, Anis Izzatty Ruslan (“Anis”), and for allegedly obstructing a public servant in the discharge of his/her public functions pursuant to sections 363 and 186 of the Penal Code respectively. &lt;br /&gt;&lt;br /&gt;On 21 June 2018, Siti Kasim was informed that Anis had been taken to Kajang Hospital for a medical examination without her consent.  Anis, on the advice of Siti Kasim, left the hospital and thereafter, sought temporary refuge at Siti Kasim’s home. &lt;br /&gt;&lt;br /&gt;Subsequently on 23 June 2018, a number of police officers forcibly gained entry into Siti Kasim’s home when she was not in by breaking open several locked doors to gain access to Anis, allegedly to prevent her from injuring herself and others. &lt;br /&gt;&lt;br /&gt;When Siti Kasim queried the police as to the whereabouts of Anis, she was asked to report to the Kajang Police Station.  Here she was arrested pursuant to section 363 and section 186 of the Penal Code.  She was thereafter handcuffed and remanded overnight before being produced at the Kajang Magistrates’ Court on 24 June 2018.&lt;br /&gt;&lt;br /&gt;At the remand hearing, the police sought a four-day remand order.  However this was only in respect of the allegation of obstruction of a public servant under section 186, and interestingly, there was no reference of the initial allegation of kidnapping.  After hearing submissions from all parties, the Magistrate refused to grant the application for remand.  The police are said to be still investigating the matter. &lt;br /&gt;&lt;br /&gt;It is pertinent to note that Siti Kasim was at all material times discharging her duties as an advocate and solicitor, as instructed and appointed by her client.&lt;br /&gt;&lt;br /&gt;&lt;a href='http://www.malaysianbar.org.my/' target='_blank'&gt;http://www.malaysianbar.org.my/&lt;/a&gt;</description>

            <title>Respecting letter and spirit of the Constitution</title>

At the same time, GE14 was the dirtiest of all elections since Merdeka. The Registrar of Societies turned a blind eye towards Umno’s violation of its own Constitution. She refused to register the Pakatan Harapan coalition and deregistered Tun Dr Mahathir Mohamad’s Parti Pribumi Bersatu Malaysia.&lt;br /&gt;&lt;br /&gt;Under Article 114(2), the Election Commission must enjoy public confidence. Instead, it resorted to massive gerrymandering and malapportionment, and ignored citizens’ complaints. It defiled Opposition billboards. A Rantau state seat candidate was refused entry into the nomination centre. Tian Chua was declared disqualified. During the run-up to the election, blatant acts of bribery by both sides went uncensured.&lt;br /&gt;&lt;br /&gt;Tian Chua’s attempt to seek judicial review was turned down by the High Court. All other court cases to challenge the misconduct of the EC failed. The EC delayed the issuance of many results where the then Opposition was winning. In several recounts, Barisan Nasional emerged triumphant. The EC submitted the official results to the King only on the afternoon of May 10.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;AG’s appointment: The Attorney General is the ruling government’s solicitor and confidant. He must be chosen by the political executive and not the Yang di-Pertuan Agong or the Conference of Rulers. Article 145 mandates that “the Yang di-Pertuan Agong shall, on the advice of the Prime Minister, appoint a person who is qualified to be a judge of the federal court to be the Attorney General for the federation”. The King can counsel and delay but if the PM insists on his nominee, the monarch is bound by advice in accordance with Article 40(1) and (1A).&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Role of Conference of Rulers: Many appointments, like those of judges, have to be referred to the Conference of Rulers for consultation but the appointment of Cabinet ministers and the Attorney General has no such consultation requirement. However, under powers vested by Article 38(2), the Conference may deliberate on any matter it thinks fit, including the suitability of the Attorney General. Even if this is so, the Conference only deliberates and advises. It does not decide. The choice of the Prime Minister is binding on the King.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;&lt;b&gt;AG’s race and religion: There is no prescription in the Constitution of the AG’s race, religion, region or gender. In the past, we have had non-Muslim AGs. Except in relation to the Sultans, the Malay regiment and the Mentris Besar in the nine Malay states, the Constitution is blind to race and colour. Under Articles 8(1), 8(2) and 136, the rule of equality before the law applies.&lt;br /&gt;&lt;br /&gt;The argument by some that as the King is the head of the religion of Islam, therefore the AG must be a Muslim, is a thinly disguised attempt to misuse Islam to deprive non-Malays and non-Muslims of any place in the corridors of power. Contrary to what some religious preachers preach, Islam is perfectly capable of inclusiveness and such twisted arguments bring Islam a bad name.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;&lt;b&gt;We have had two non-Muslim AGs before:&lt;/b&gt; Thomas Vernor Alexander Brodie (1955-59) and Cecil M. Sheridan (1959-63). &lt;b&gt;Even the Muslim ones were not experts in Islam&lt;/b&gt; and they relied on their 1,800-strong team to draft opinions and laws on all matters including the syariah. As to counselling the King on matters of Islam, Article 3(5) provides that Parliament may by law constitute a Council to advise the King in matters relating to Islam. A parliamentary initiative on this matter to legalise institutions like the Malaysian Islamic Development Department (Jakim) and define their jurisdiction is necessary. &lt;b&gt;As to prosecution, Article 145(3) excludes the Syariah courts from the AG’s jurisdiction.&lt;br /&gt;&lt;/b&gt;&lt;br /&gt;Conventions: A cunning argument has been proffered that a convention exists that all top positions must be occupied by Muslims. No such convention exists. In any case, conventions cannot violate the explicit provisions of Articles 8 and 136. Conventions exist to fill gaps in the law, not to trump the law.&lt;br /&gt;&lt;br /&gt;AG and Parliament: Pakatan’s undertaking that the AG must be answerable to Parliament is achievable by appointing the new AG as one of the 44 appointed Senators.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;AG and criminal law: Opinions have been expressed that the AG must be a criminal litigator. Tommy Thomas is an expert in constitutional law. With all due respect, constitutional law and criminal law overlap. The Constitution’s Article 5 on personal liberty, Article 7(1) on retrospective criminal laws, Article 7(2) on double jeopardy, and Articles 149-151 on subversion and emergency, are intimately connected with the criminal process.&lt;br /&gt;&lt;br /&gt;In any case, the Pakatan government intends to separate the AG from the public prosecutor. The newly appointed AG will preside over this magnificent transformation. His expertise in constitutional law may reverse the trend of the last few decades where judges, officers of the AG’s Chambers, the police, politicians and administrators sidestep the imperatives of the Constitution.&lt;br /&gt;&lt;br /&gt;If the new AG can restore the Constitution to the pedestal on which it was placed when Malaya began its tryst with destiny, if he can advise his officers to regard our Constitution as our chart and compass and sail and anchor, he will have the gratitude of a large part of the citizenry.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;Emeritus Professor Datuk Dr Shad Saleem Faruqi is holder of the Tunku Abdul Rahman Chair at Universiti Malaya.             <description>PETALING JAYA: Petaling Jaya Utara MP Tony Pua has warned that a recent “open attack” by a deputy minister in Parliament in claiming that atheism is unconstitutional opens a new chapter in diminishing the religious rights of ordinary Malaysians.&lt;br /&gt;&lt;br /&gt;Pua, who is also DAP publicity secretary said&lt;b&gt; Asyraf Wajdi Dusuki, who holds the position in the prime minister’s department, was “talking utter rubbish”.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;He said the Federal Constitution states that “every person has the right to profess and practise his religion.”&lt;br /&gt;&lt;br /&gt;&lt;b&gt;“How in the world did Datuk Asyraf interpret someone having ‘the right to profess’ to everyone ‘must profess’ a religion?” Pua said in a statement today.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;On Friday, Asyraf said in the Dewan Rakyat that atheism had no place in Malaysia as it contravened both the constitution and the Rukunegara.&lt;br /&gt;&lt;br /&gt;He said that in the Malaysian context, freedom of religion did not mean freedom from any religion.&lt;br /&gt;&lt;br /&gt;He added that atheism attacked other religions, which would contravene laws on public order.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;To illustrate his point, Pua asked if Asyraf would interpret Article 10 of the constitution that “every citizen has the right to freedom of speech” and “all citizens have the right to assemble peaceably and without arms” as meaning that “everyone must speak” and that “everyone cannot refuse to participate in peaceful assembly”.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;&lt;b&gt;“Of course not. When someone ‘has the right to profess… his religion’ (under Article 11), it clearly means that he has the freedom of choice to believe in a religion. But it does not at any point compel him or her to adopt a religion,” he said.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;Pua also said an atheist or a free-thinker did not by default run afoul of Article 11(4) which prohibits propagating other beliefs to Muslims, by not believing in any religion or participating in religious activities.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;“That would be sheer illogical nonsense,” he said. “Unfortunately, propagating illogical nonsense isn’t illegal in Malaysia,” he said, adding that there was now however, an increasing constriction of religious rights and freedom of all Malaysians.&lt;br /&gt;&lt;/b&gt;&lt;br /&gt;He claimed that the “ruling political elite” was using the issue to strengthen their grip by striking fear in Muslims.&lt;br /&gt;&lt;b&gt;&lt;br /&gt;He said they were doing this by focussing on the purported threat of Christianity and were now targeting atheism, as well as taking away the freedom of non-Muslims “one bit at a time”.&lt;br /&gt;&lt;/b&gt;&lt;br /&gt;On Aug 16, then inspector-general of police Khalid Abu Bakar said the constitution recognised Islam as the official religion and had no provision for atheism.&lt;br /&gt;&lt;br /&gt;He also said police would scrutinise the country’s existing laws so appropriate action could be taken should atheists cause anxiety among Muslims.&lt;br /&gt;&lt;br /&gt;A week earlier, federal minister Shahidan Kassim made headlines locally and abroad when he said atheists should be “hunted down”, as they were in violation of the constitution.&lt;br /&gt;&lt;br /&gt;&lt;a href='http://www.freemalaysiatoday.com/category/nation/2017/11/26/pua-attack-on-atheism-opens-new-chapter-in-shrinking-rights/' target='_blank'&gt;http://www.freemalaysiatoday.com/category/...rinking-rights/&lt;/a&gt;</description>

            <description>KUALA LUMPUR: There is nothing in the Federal Constitution which makes atheism unconstitutional in Malaysia, said law professor Shad Saleem Faruqi.&lt;br /&gt;&lt;br /&gt;“While belief in God is in the Rukunegara, atheism is neither permitted nor prohibited in the Federal Constitution,” Shad told Berita Daily.&lt;br /&gt;&lt;br /&gt;He also raised a question on freedom of religion in Malaysia, especially for non-Muslims.&lt;br /&gt;&lt;br /&gt;“The million dollar question now is, does freedom of religion includes freedom not to belief? For Muslims it is a crime but for non Muslims, it is not.&lt;br /&gt;&lt;br /&gt;“Under shariah laws, there is no right for disbelievers because Islam is about submission to Allah. Non Muslims have always been given a choice to belief.”&lt;br /&gt;&lt;br /&gt;He said this in reaction to deputy minister in charge of Islamic affairs, Asyraf Wajdi Dusuki who said that atheism should not be allowed in Malaysia.&lt;br /&gt;&lt;br /&gt;“Atheism contradicts the first principle of the Rukunegara, which is a belief in God.&lt;br /&gt;&lt;br /&gt;“We need to understand, that in the Malaysian context, our Federal Constitution states that freedom of religion is not freedom from religion,” he said.&lt;br /&gt;&lt;br /&gt;“It is unconstitutional to say we can spread ideologies that incite people to leave a religion or profess no religion at all,” he said in reply to a question by Dr Siti Mariah Mahmud (Amanah – Kota Raja) in Parliament earlier today.&lt;br /&gt;&lt;br /&gt;Shad also said that there were many religions practised in Malaysia that did not have God.&lt;br /&gt;&lt;br /&gt;“In Sikhism, Buddhism and Chinese religions such as Confucianism there is no God but sets of values from inspired prophets such as honesty and integrity.”&lt;br /&gt;&lt;br /&gt;He also said that the government should not be imposing the concept of submission to God in Islam to followers of other faiths.&lt;br /&gt;&lt;br /&gt;“Instead of searching for the devil that doesn’t exist, non Muslims should be left alone,” he added.&lt;br /&gt;&lt;br /&gt;The Universiti Malaya-based professor also pointed out that the Universal Declaration of Human Rights also included the right to not belief.&lt;br /&gt;&lt;br /&gt;He also dismissed the notion that atheism would lead to public disorder.&lt;br /&gt;&lt;br /&gt;“It is a sensational statement. Atheism hasn’t created public disorder for 60 over years. There is a doctrine of clear and present danger in US. In this case, there is none.”&lt;br /&gt;&lt;br /&gt;Looking at a bigger picture Shad said that there were countries without religion practising humanism.&lt;br /&gt;&lt;br /&gt;“What is wrong in practising values such as honesty?”&lt;br /&gt;&lt;br /&gt;He added that Asyraf’s claim that atheism can lead to public disorder was not supported by corresponding social data.</description>
