KOTA KINABALU, Sept 8 — PAS MP Nik Muhammad Zawawi Salleh’s claim that the Bible was “distorted” could cost Perikatan Nasional (PN) and allied local parties votes in the state election due to their refusal to criticise him, according to observers.

In Parliament last month, Nik Zawawi from PAS claimed the Bible has been distorted from its original meaning and outraged Christians including those in Sabah that will head to the ballot box on September 26.

Multicultural Parti Bersatu Sabah has been the only PN-friendly party to openly criticise him, calling his remarks seditious and “unforgivable” while trying to dissociate themselves from the conservative Islamic party.

Its information chief, Datuk Joniston Bangkuai, sought to dismiss PAS as inconsequential here by noting that the Islamist party has not had any electoral success of note.

“We may be together in the federal government administration but politically we have nothing to do PAS... we are neither a component member of PN and BN (Barisan Nasional),” Bangkuai said.

When asked whether Sabah voters would see it that way during the state election, Bangkuai pointed out that PBS was contesting under its own banner.

PBS had been part of the BN coalition but abandoned it along with other East Malaysian components following its 2018 general election defeat.

“We are contesting using our own symbol and not PN or BN symbol... that should be clear enough,” he said.

However, not all believe this distinction alone would let PN-linked parties escape the fallout of Nik Zawawi’s comments.

UITM political analyst Tony Paridi Bagang said those allied with PN and the related Muafakat Nasional (MN) will have to do serious damage control or at least present a credible counter-narrative if they intend to fare well during the September 26 poll.

Unlike the peninsula where racial polarisation was more prominent, he said both Sabah and the neighbouring Sarawak were known for their moderation, multiculturalism, and multi-religiousness.

“PAS’s comment would make PN efforts to be more challenging in convincing the non Muslim people here,” he said.

Despite this prognosis, however, only PBS has openly condemned Nik Zawawi over the incidents.

According to Bagang, this could expose PN-linked parties as voters may interpret their refusal to condemn the PAS lawmaker as tacit approval for his remarks.

“Perceptually, this is not good for their party’s image. It does not give advantage to PN especially PAS as this may create a negative perception and harping the sentiment over identity politics.

“This issue has been picked up by their opponents to be capitalised as a political issue,” Bagang said.

As the UiTM analyst noted, parties aligned with the ruling coalition under Parti Warisan Sabah have seized on their local rivals’ inability or unwillingness to criticise the PN federal lawmaker over the incident.

Among others, United Progressive Kinabalu Organisation (Upko) information chief Albert Bingkasan agreed that this was certain to erode voters’ faith in any party with ties to PAS, be it directly in PN or through an informal arrangement.

“Yes, it does dent those parties especially because they hardly spoke up against such a bigoted comment.

“I do know many people of other religions who are aghast at PAS — and Umno, for that matter — as well as all those aligned to PN and Semenanjung; the PAS comment kind of heightened the people’s anger,” he said.

Bingkasan said that in Sabah, Muslims were against insults to other religions, deeming them out of line.

He noted, however, that politicians in the peninsula had little qualm against using race and religion, especially around elections.

While debating the Road Transport (Amendment) Bill 2020 to propose heavier fines for drink-driving offenders, the Pasir Puteh MP asserted that the Bible has been perverted or corrupted, which immediately drew condemnation from other MPs

The Christian Federation of Malaysia, the Sabah Council of Churches, and Association of Churches in Sarawak have all criticised the unrepentant Nik Zawawi, who suggested the Christian community had “no right to be offended” as his claim was a “fact”.

Despite the apparent anger, PN and its leaders have remained largely silent about both controversies.

Christians form a significant portion of Sabah, representing over 26 per cent of the state as of 2010 versus 9.2 per cent nationally.

KUALA LUMPUR, Sept 8 — With only a few days left before nomination day, Sabah’s Parti Solidariti Tanah Airku (STAR) Datuk Jeffrey Kitingan has threatened to pull out of the Perikatan Nasional (PN) alliance if his party does not get at least 15 seats to contest.

Astro Awani reported that the Keningau MP was basing his demands on the people’s aspirations to have local parties run Sabah.

“We are confident STAR can win many more seats in this state election and we are ready to contest 15 to 18 seats if given the opportunity.

“But if we are given only six to eight seats, then we might as well run on our own,” he was quoted as saying.

In the PN-friendly alliance, STAR has to share some 24 out of 73 seats that have a majority of non-Muslim natives — colloquially known as KDM which stands for Kadazan Dusun Muruts — with parties like Parti Bersatu Sabah and Parti Bersatu Rakyat Sabah.

“The current sentiment is that Malaya-based parties are too domineering and the people are tired of this and don’t want this anymore. That’s why the seat allocation has to be divided fair and square to respect Sabah-based parties,” he said.

He also said that Sabahans wanted the number of BN seats to be fewer than or equal to local parties.

The parties that are contesting this election which are considered PN friendly also include Parti Pribumi Bersatu Malaysia, and BN’s Umno, MCA and MIC, while PAS and SAPP are also part of the equation.

In a crowded Opposition, many seats are expected to see at least five-cornered fights.

Court of Appeal dismisses Musa Aman, 32 others’ le

PUTRAJAYA, Sept 8 — The Court of Appeal today dismissed former Sabah chief minister Tan Sri Musa Aman’s application for leave to initiate a judicial review against the state assembly’s dissolution.

A three-judge bench consisting of Datuk Abdul Karim Abdul Jalil, Datuk Abu Bakar Jais and Datuk Supang Lian today dismissed the application by Musa and 32 others on the grounds that the courts are not to interfere with matters decided upon by state leaders, such as the dissolution of state legislative assembly.

“We are of the position that the TYT (Yang Di Pertua Negeri) had correctly exercised his discretionary powers as stated within the provisions of the Sabah state Constitution including the issuance of the proclamation (of the dissolution) on July 30, 2020.

“We find there is no appealable error and therefore dismiss the appeal and affirm the decision of the learned judicial commissioner,” read Abdul Karim.

The bench later also dismissed an oral application by Musa’s counsel Datuk Firoz Hussein Ahmad Jamaluddin for a stay of matters and the decision, including the election.

Musa, who was in court when the judgment was read, left the courtroom immediately without commenting.

This means the Sabah state elections, beginning with Nomination Day this Saturday and polling on September 26, will proceed as scheduled.

KOTA KINABALU: Former Sabah chief minister Tan Sri Mohd Harris Salleh, 80, is said to be planning to make a comeback in the 16th Sabah state election.

The former Berjaya (Sabah People's United Front) government chief minister between 1976 and 1984 is being courted to lead United Sabah National Organisation (Usno), which is widely seen as a “shell” of political party that was re-registered in 2013 and led by little-known politician Ibrahim Linggam.

According to a local daily, Harris neither confirmed nor denied plans to return to active politics but admitted that there were requests by Usno for him to lead.

“I cannot say for sure that I will take the challenge.

"If I decide to heed the calls, and if Usno is able to form the state government with the help of friendly parties in the opposition, my priority would be to put Sabah right economically before handing over to others,” Harris told the Daily Express, a local newspaper.

When contacted on Friday (Aug 21), Usno president Ibrahim said they were waiting for confirmation from Harris and also former Dewan Rakyat Speaker Tan Sri Pandikar Amin Mulia to join the party.

“We are getting a lot of interest from many political leaders, especially those who have been sidelined in Sabah Umno and other parties,” he said.

The original Usno was a Sabah independent party formed to represent the state’s Muslim bumiputeras and was led by Tun Datu Mustapha Harun.

The Usno led by Mustapha was dissolved with the entry of Umno into Sabah in 1991. Subsequently, certain groups started to revive it through re-registration in 2013 as Usno Baru.

Harris was among the pioneers of the party that won the first state election in 1967, but he left Usno to form Berjaya with Tun Fuad Stephens, and they toppled Usno in 1976.

Harris became Sabah chief minister hardly three months after Berjaya came to power in the state following the tragic death of the Tun Fuad in an air crash in Kota Kinabalu on June 6, 1976.

His Berjaya government lost to fledgling PBS led by Tan Sri Joseph Pairin Kitingan in 1985.

Harris made several attempts at a comeback by leading Berjaya in 1990 and Bersekutu in 1999, but failed to make any impact. Both Berjaya and Bersekutu are now defunct.

Other former chief ministers trying to make a comeback are Tan Sri Chong Kah Kiat, who led the Chinese based Liberal Democratic Party, into the polls, while former Foreign Minister Datuk Seri Anifah Aman has also taken over Parti Cinta Sabah.

If the takeover of Usno by Harris or Pandikar materialises, it will join PCS and LDP as the third force in the Sept 26 state polls.

Currently, Warisan Plus, led by caretaker chief minister Datuk Seri Mohd Shafie Apdal, is facing a challenge from Sabah Barisan led by Sabah Umno and its partners Sabah Bersatu, PBS and Sabah STAR.

KOTA KINABALU: The Yang di-Pertua Negeri of Sabah Tun Juhar Mahiruddin today expressed his disappointment with the false allegation against him that is now viral on the social media.

Juhar through his private secretary, Abinan Asli strongly denied the allegation made by the President of Gerak Kuasa Rakyat Malaysia @G57, Zulkarnain Mahdar and considered the claim as “fake and baseless”.

According to Abinan, the Istana Negeri had never received any formal or informal request from former Chief Minister Tan Sri Musa Aman to meet with the Head of State.

“Tan Sri Musa’s delegation and several State Assemblymen who are aligned with him had tried to forcefully enter the Istana Negeri at 3.50pm on July 30 without making an official application and were stopped by the police.

“The Istana Negeri did not instruct the police to stop Tan Sri Musa from entering the palace, but the blockage was carried out by the police to avoid any untoward incidents.”

“After assessing the stressful situation during that period, (and the fact that )there was no need for Tan Sri Musa Aman’s delegation to meet with the Head of State since the State Legislative Assembly has been dissolved in the morning of July 30, 2020, the Head of State did not consent for the delegation to enter the Istana Negeri and meet him.”

Zulkarnain lodged a complaint with the Malaysian Anti-Corruption Commission (MACC) in Putrajaya on Wednesday (Aug 5), claiming that Tun Juhar had abused his power in giving consent to dissolve the state assembly as requested by Chief Minister Datuk Seri Mohd Shafie Apdal.

Meanwhile, Tun Juhar urged Sabahans to remain united and maintain the racial harmony.

He reminded them to remain calm and not be easily swayed by fake news.

KUALA LUMPUR, May 29 — The Malaysian government’s stern position against drunk driving that cause deaths in road accidents does not mean that non-Muslims in the country would not be allowed to drink alcohol, minister in charge of parliament and law Datuk Takiyuddin Hassan clarified today.

Takiyuddin however said non-Muslims would have to obey the relevant laws when drinking alcohol.

“Although the government is firm in the issue of fatal accidents involving drunk drivers, it does not mean the government is denying the right of non-Muslims to drink alcohol. They are free to do so, as long as they comply with all related legal provisions,” the Kota Bharu MP and PAS secretary-general concluded in a statement today.

Earlier in the same statement in his capacity as the minister in charge of law, Takiyuddin said the government was paying serious attention to and would be taking firm action on cases of fatal road accidents involving drunk drivers, which he said had recently been on the rise.

Takiyuddin explained that an immediate step that would be taken is to ensure that the proposal for an amendment of the Road Transport Act 1987 as finalised by the Transport Ministry would be brought to the next Parliament meeting.

The proposed amendments are expected to be related to Section 44 of the same law regarding driving while being drunk and causing injuries or deaths, as well as Section 45 which relates to those driving under the influence even though they are not involved in any road accidents, Takiyuddin said.

Takiyuddin said the government also backs the proposal of changing the law to make it compulsory for a jail term to be given to those convicted under Section 45, instead of leaving it to the courts’ discretion.

“The government is also very supportive of the Transport Ministry’s proposal to set a mandatory jail term on drivers who are arrested for driving while intoxicated (Section 45), which according to the existing provisions are still under the discretionary power of the courts,” he said.

“By increasing the rate of fine and jail term, the Attorney-General, after the amendment is carried out, can prosecute offenders at the Sessions Court that has a higher jurisdiction,” he added.

Checks show that the Road Transport Act’s Section 44 covers the offence of driving — while being unable to have proper control of the vehicle due to the influence of alcohol or drugs, or whose alcohol levels in the body exceeds the prescribed limit — and causing a person to be injured or to die.

The penalty for the Section 44 offence is a jail term of between three to 10 years and a fine of between RM8,000 to RM20,000. Section 44 also disqualifies a person convicted of this offence from having a driving licence for at least five years, or for 10 years if they repeat the offence.

The Road Transport Act’s Section 45 covers the offence of being in charge of a vehicle and being incapable of having proper control of it due to the influence of alcohol or drugs, despite not driving the vehicle. This is punishable by a maximum fine of RM1,000 and maximum three-month jail term for first-term offenders, with higher penalties of a fine of RM2,000 to RM6,000 and a maximum 12-month jail term for repeat offenders with provisions for disqualification from holding a driving licence for a certain period.

In the same statement, Takiyuddin said the government would discuss with the Attorney-General’s Chambers for a deterrent step to be taken by having cases involving deaths caused by drunk drivers to also be investigated and prosecuted under the Penal Code, including under Section 302 for causing death intentionally or Section 307 for attempt to murder intentionally.

A check of the Penal Code shows Section 302 stating that the penalty for murder is a death sentence, while Section 307 covers the offence of attempt to murder which comes with various penalties including jail sentences.

“Besides that, the police also have to help the families of victims of fatal road accidents caused by drunk drivers, especially to enable them to make civil claims in court which is their right under the law,” he added.

PETALING JAYA, May 29 — Bersatu secretary-general Datuk Seri Hamzah Zainudin has insisted that Tun Dr Mahathir Mohamad and four of the party’s MPs have lost their positions and memberships in the party according to its constitution.

He said that although the party’s disciplinary chairman has received numerous complaints about Dr Mahathir’s faction, including joint statements with the Pakatan Harapan Opposition and his no-confidence motion in Parliament, it was all irrelevant as the group had breached clause 10.2.2 and 10.2.3 of the party’s constitution that states that party members are not allowed to join any other political parties.

“In this matter, disciplinary board chairman Tan Sri Megat Najmudin has told me as the secretary-general this no longer needs to be brought to the board as their membership was revoked under clause 10.2.2 and 10.2.3.

“I want to emphasise that they were not fired but their membership was suspended for violating the party’s constitution.

“The party membership is greater than the individual and no one is above the party’s constitution,” he said during a press conference at the Bersatu headquarters here today.

Hamzah also said the decision also makes all five — Dr Mahathir, Datuk Seri Mukhriz Mahathir, Datuk Amiruddin Hamzah, Syed Saddiq Abdul Rahman and Maszlee Malik — not qualified to contest in the ongoing party polls.

‘Kayangan’ or ‘bumi’, everyone is equal under CMCO

PUTRAJAYA, May 27 — Anyone who violates the standard operating procedure (SOP) during the Aidilfitri celebration throughout the conditional movement control order (CMCO) period will be subjected to the appropriate action, said Senior Minister (Security Cluster) Datuk Seri Ismail Sabri Yaakob.

He said the SOP applies to all regardless of whether they are dignitaries or ordinary people, and it is up to the Royal Malaysia Police (PDRM) to act against the violators.

“There is no difference between the “kayangan” (VIP) and “bumi” clusters (ordinary people); anyone committing an offence while celebrating Aidilfitri during CMCO is liable to face action by the enforcement authorities,” he said at a daily CMCO media conference here today.

He was asked to comment on a handful of dignitaries who apparently violated the SOP on social distancing and number of guests allowed at Aidilfitri celebration, as shown on photos they shared on social media.

Meanwhile, Ismail Sabri was also asked on the permission for support staff (AKP) in schools to return to work.

He said they have already been directed to work from the office, just like other civil servants.

“They are support staff such as clerks...the Chief Secretary to the Government had announced the reopening of government agencies and that civil servants can start work, and the AKP is a part of civil servants,” he said.

Ismail Sabri also said that since April 27, a total of 53,785 students who were staying on campus had been sent back to their hometowns by the Ministry of Higher Education.

“Yesterday, the ministry sent home 1,144 students by four flights from Kuala Lumpur to Kota Kinabalu.

“Today, 584 students will be flown out to their hometowns via two flights from Kuala Lumpur to Kota Kinabalu,” he said.

He said the students involved would have to take swab tests before flying home. — Bernama

Mat rempit’ among 22 youths slapped with compounds

BUTTERWORTH, May 28 — Seven mat rempit (illegal motorcycle racers) were among 22 people slapped with the RM1,000 compound each for defying the conditional movement control order (CMCO) yesterday.

Seberang Perai Utara (SPU) district police chief ACP Noorzainy Mohd Noor said 15 of them, who are secondary school students and from institutions of higher learning, aged between 18 and 25, were caught playing basketball at Taman Teratai Indah here.

“Prior to that, the police have warned them against engaging in such sports activity. Yesterday was the second time they were approached by the police for playing basketball there,” he told reporters here today.

On the mat rempit, he said, they were caught while gathering at a fuel station in Jalan Penaga, Kepala Batas near here.

“When questioned by the police, they were not able to provide valid reasons for being at the fuel station and checks on their motorcycles found that the machine had been modified and had no road tax,” he added.

He said four of them, who are secondary school students aged between 13 and 16, had no driving licence.

KUALA LUMPUR, May 27 — Langkawi lawmaker Tun Dr Mahathir Mohamad has challenged the Kedah state government to prove that it has been issued with a RM1 billion lawsuit by logging companies after their concessions were revoked by the previous administration

In a scathing post on his Facebook page today, the former prime minister questioned whether the administration under Mentri Besar Muhammad Sanusi Md Nor was so frightened of a few loggers that they were going to kowtow to their demands.

“Now, another history has been made. Kedah’s treasures are being plundered for the strategic investments of the loggers. Don’t sell the people. Don’t sell the forests. Don’t sell Kedah’s treasures for your friends, the loggers.

“You’re frightened of being sued by the loggers? You said there’s a lawsuit of RM1 billion? You would bow down to the loggers? Prove that the RM1 billion lawsuit exists and that the state government will lose. Be courageous because of the truth.

“May Allah protect Kedah from the hands of untrustworthy leaders,” said Dr Mahathir.

He then pointed out that when Pakatan Harapan (PH) administered the state, the logging concessions were stopped to save water catchment areas for the benefit of four million people.

Instead of lining the pockets of unscrupulous loggers, the PH administration prioritised the needs of the public, the farmers and the country instead of rich loggers.

By stopping the logging concessions from continuing to destroy the environment for money, the PH administration ensured that there were enough catchment areas to supply water to the paddy fields in Kedah and Perlis that contribute to 50 per cent of Malaysia’s national rice production.

Dr Mahathir pointed out that under the leadership of then Mentri Besar Datuk Seri Mukhriz Mahathir, who is also his son, the state’s investment strategic value had leapt threefold to RM7.71 billion in 2019 from RM2.3 billion in 2018 — without the need to pander to loggers.

“Our youths had high paying jobs in new factories at Kulim Hi-tech park. Now the loggers are getting new jobs. Previously, Kedah created history by recording the third-highest investment in the manufacturing sector after Selangor and Penang. It was a 400 per cent increase from 2018,” he said.

The game is due to launch globally on June 19, but currently does not appear among the listings for the Saudi Arabia and United Arab Emirates versions of the PlayStation Store.

You can still buy dynamic themes and avatars based on the game, and the PlayStation Arabia Twitter account is still promoting tomorrow's State of Play broadcast, which will go into more detail about the title.

One Reddit user, spotted by VG247, reports that PlayStation Support said any game that does not appear in a regional store has been "banned by the competent authorities of the country and we can not do anything regarding that."

Muhyiddin, Tengku Zafrul appointed to Khazanah boa

KUALA LUMPUR: The Ministry of Finance (MoF) has announced the appointment of Prime Minister, Tan Sri Muhyiddin Yassin as the chairman of Khazanah Nasional Bhd.

In a statement today, the MoF said Finance Minister Tengku Datuk Seri Zafrul Abdul Aziz as well as Datuk Mohammed Azlan Hashim have been appointed as its members, adding that the appointments are effective immediately.
In a separate statement, Khazanah said it is looking forward to work with the newly-reconstituted board in fulfilling its mandate as the sovereign wealth fund of Malaysia.

It had also announced that Tun Dr Mahathir Mohamad has stepped down as chairman and member of the board, effective March 25, 2020.
"On behalf of the management and staff, Khazanah would like record our thanks and appreciation to Tun Dr Mahathir for his leadership, guidance and contributions throughout his tenure as chairman," added Khazanah.

Case management of Sabah church’s appeal on ‘Allah

KUALA LUMPUR, April 1 — The case management for Sidang Injil Borneo (SIB) Church’s appeal on the discovery of documents pertaining to the Cabinet’s decision in 1986 which prohibited the use of the word “Allah” in non-Muslim publications, has been rescheduled to April 30.

Senior federal counsel Shamsul Bolhassan, when contacted by Bernama today, said it was earlier fixed for today before Court of Appeal deputy registrar Jalidah Hamid, but it was vacated.

“We received an email from the court notifying that the case management for SIB’s appeal which was scheduled today, has been vacated. The next case management has been fixed on April 30 at the Court of Appeal,” he said.

On Oct 16, 2017, the High Court in Kuala Lumpur dismissed the church’s application for the documents, ruling that the documents were classified under the Official Secrets Act (OSA) and could not be released.

The documents were requested by the church and its president, Datuk Jerry WA Dusing @ Jerry W. Pate, in a judicial review application filed on Dec 10, 2007 against the Home Ministry and the government over their right to use the word Allah to refer to God in their religious publications.

The application was also filed to challenge the decision of the Royal Malaysian Customs to seize religious books brought in from Surabaya, Indonesia, which contained the word Allah, at the low cost carrier terminal in Sepang on Aug 15, 2007.

They are seeking a declaration that they have a constitutional right to use the word Allah in their Bahasa Malaysia and Bahasa Indonesia-translated Christian bibles and in all their religious publications and materials.

On Oct 1, 2014, the Court of Appeal gave the nod to the church to initiate a judicial review application over the right to use the word “Allah” in all its religious publications and materials after Kuala Lumpur High Court on May 5, 2014 dismissed the SIB church’s leave application to commence a judicial review.

Following the Court of Appeal’s decision, the matter was remitted to the High Court for hearing on the merits of the church’s judicial review.

However, the merits of the judicial review have yet to be heard at the High Court as SIB had first applied to obtain documents. — Bernama

MCO: ESSCom working closely with Philippine forces

SANDAKAN, April 1 — The Eastern Sabah Security Command (ESSCom) is constantly working with Philippine security forces to tighten security and curb cross-boundary criminal threats, especially during the ongoing movement control order (MCO) period.

Its chief executive officer Noor Alam Khan A Wahid said ESSCom had received information recently of a failed attempt to encroach Malaysian waters by what it believes to be a kidnap for ransom group from a neighbouring country.

“The attempt to enter Malaysian waters is believed to have taken place on March 29.

“ESSCom will continue to patrol our waters, including during the MCO period, so that no party takes advantage of the ongoing situation to commit crimes,” he told reporters after handing out ‘bubur lambuk’ (savoury porridge) contributed by ESSCom to frontliners such as medical workers, the police and members of the Armed Forces here today.

Besides patrolling the waters, he said ESSCom will continue operations at road checkpoints in Sapi Nangoh and Kalabakan, despite the many roadblocks already mounted there during the MCO.

As for the bubur lambuk contribution, Noor Alam said it was a sign of appreciation for the frontliners’ sacrifices in ensuring MCO directives are adhered to and for the people to remain safe from Covid-19 infection. — Bernama
