Protect Ur Rights as M'sian Employees! EA1955

QUOTE

Hypothetical Situation:
"Mr. Ayam has had it with his current employer due to a toxic work environment. He decided to tender his resignation and serve three month of notice period, according to the offer letter he signed upon joining the sh*tty company. Things goes according to plan till his st*pid HR rep sent him an acceptance of resignation letter. Inside that letter the employer decided to shorten his notice period from three months to two weeks, without compensating Mr. Ayam with payment in lieu. Also, the employer decided to 'burn' his annual leave balance to shorten his notice period so Mr. Ayam won't get any encashment from his balance annual leave. To add wound to the salt, the employer decided to withold Mr. Ayam salary till the end of the month even though his last day of employment is the 1st week of the month."

How the Malaysian Employment Act 1955 (EA1955) can help Mr. Ayam?

» Click to show Spoiler - click again to hide... «

1) EA1955 Section 13 - Termination of contract without notice
Employee or employer may terminate the contract of employment without notice by paying the other party payment in lieu according to the offer letter (if notice period three months, either party need pay three months worth of salary laa).

2) EA1955 Section 20 - Payment on normal termination of contract
Employee last drawn salary must be paid no later than the day the employee contract terminate. If your last day is on the 15th, then your employer must pay no later than 15th lah. "Mr. Ayam we must withold your salary until we get a clearance from LHDN, on Form CP22A..." Somewhat true, but the st*pid HR rep already know the day of Mr. Ayam departure from the company so why must they delay getting this process done (will not take up more than 10 working days). Thus, EA1955 Section 20 come to effect! Pay me on my last day of employment at this sh*ty company.

3) EA1955 Section 60E(3A) - Annual Leave
If an employee cannot finished their entitled annual leave balance upon resignation, the employer must pay the employee according to their daily rate of pay (RMXXXX / 26 days = daily salary). This is where it gets tricky because its borderline touching the Malaysian Industrial Relations Act 1967, so I don't want to complicates things. In short, your employer cannot willy nilly use your balance annual leave to shorten the notice period, unless with your approval/request it (but subjected to employer discretion). Annual leave is your rights, encashment vs can leave early from sh*ty company?

Thanks for the tips! Mr. Ayam already advice the st*pid HR rep but they downright belittle him by saying "No such thing laa... You sign the offer letter when joining, must follow coz its in the contract one!". You can re-advise the sh*ty company by highlighting the EA1955, especially on section;

» Click to show Spoiler - click again to hide... «

4) EA1955 Section 91(A)
Any employer fails to pay salary or payment in lieu to employee as prescribed under section 20, commits an offence.

5) EA1955 Section 99A - General penalty
Any person who commits any offence under Malaysian Employment Act 1955 or its relevant regulations, shall be liable of penalty to a fine not exceeding RM50,000.00

6) EA1955 Section 100(4) - Penalties for failure or non-compliance in relation to annual leave
Any employer who breach EA1955 Section 60E commits an offence

Here's my favorite part under EA1955 to get Mr. Ayam st*pid HR rep to comply and adhere to the Malaysian Employment Act 1955;

7) EA1955 Section 101B(A) - Offence by body corporate, etc.
In the case of a body corporate (Sdn Bhd/Berhad), any person who is a director, manager or other similar officer of the body corporate at the time of the offence, shall be deemed to have committed the offence and may be charged jointly in the same proceeeding.

If up to this point they still wouldn't comply to the Malaysian Employment Act 1955, pretty much game over for that company lorh.
Seeking Advice for Career

Hi Serious Kopitiam,
I just received two job offer letters but I want to seek opinions from other senior forum members. I can't decide which one is the best, maybe reading your opinion and clarification can ease my decision-making process.

Company A
- If choose to drive, 19KM away one hour drive from Kota Damansara to Mid Valley. Parking HR said, roughly RM200/m.
- Accessible via LRT & MRT (one hour too for commute), can subscribe to RM50/m unlimited pass.
- Working hours 9 am to 6 pm, Monday to Friday (maybe it's relevant for commuting?)
- Job scope more towards administration, office management, and handling offshore crew. HR said, need to standby even on the weekend/public holiday as crew change is unpredictable.
- Oil and gas industry.
- Salary RM2,700.00 before deduction, medical benefits, and 14 days AL. Employers give 3% extra EPF to employees

Company B
- Can drive as a company located beside Kota Damansara only. Can park outside at MBPJ parking bay at RM100/m
- Clear job scope as Company B, gave me the position of Recruiter.
- IT solutions / Business consulting company with MSC Malaysia Status.
- Salary RM2,500.00 before deduction, medical benefits, and 10 days AL.

I would love to expand my career in the human resource field but should I choose to work in the oil&gas company because it's more "panas"/prestigious? Although Company A salary is a much better salary package, should I choose it? I really do want to see other members' points of view regarding this.

Thanks in advance
Come Read My Experience (Mid 20s, Malay)

Just sharing my romantic pursuit with you guys. Who knows maybe my story can inject some hope into you guys to pursue your own romantic journey and in return, I can get feedback from you guys or gals. Currently, I am in my mid-20s, a Malay guy, Earning 30k per year, pursuing my Master Degree’s at Universiti Malaya, and am an INTJ personality (tested on 3 separate occasions).

The Exposition

» Click to show Spoiler - click again to hide... «

It all started on the mid of October 2021, when I started my 1st semester as a postgraduate student. It was a Marketing Management subject and everyone has been assigned automatically into their own group by Microsoft Teams. As usual, my name is always picked as a group leader. When the lecturer gave the proforma/guidelines for the subject big assignment, this girl texted me "How do you want to proceed group leader?". As I mentioned earlier in this cupid section, I straightaway uses the big stick and decided to give her a call to subconsciously display that I am a bold and no funny business person (in reality, I'm just lazy to type long sentences)

Who knew that using this strategy has had a tremendous impact on my relationship with her until now. Every time she texted to ask me about study assignments, I will always reply back "Typing is tiring, let's have a phone conversation". This is a very naughty tactic because I want to see after providing her with the details, will she stick around and talk about stuff unrelated to study. It worked! From that point on, she is the one who initiates the phone conversation with me without fail almost every night.

"Woman primary love need is; care. If we can provide this need to her, she will revert with a sense of trust to men" - Men from Mars, Women from Venus

"Women are aroused by men who perform bold behaviors towards them. It turns her on" - Mark Manson. I took this man's word as my holy scripture and boy did I execute the boldest move ever. I was on my way to Johor for a group assignment during the flash flood fiasco last December, prior to boarding the bus that night I gave her a call to say that I'm unable to continue our nightly call. Just testing the water to see what is her reaction. To my surprise, she gave me a weather update and instructed me to text her once I reach JB.

The trap has been laid by me. So, when I took the bus to KL the next day I teasingly said "You mentioned you are from Kuala Selangor right? I might take the bus there so you can come to pick me up". Viola! I received a positive reaction from her because she gave me her exact location and said that she has a lot of spare room if I wanted to come over to her house. I set the date for the end of December and she agrees. But, not staying over lah just to go around and go on a date in her hometown.

"The bolder your action, the greater attraction you're going to create. The bolder the action, the more vulnerability you show and the more you polarize responses." - Mark Manson

30th December, I took my AL to meet her for the first time. Before I even begin the journey, I bought a tub of Inside Scoop Valrhona ice cream. Not solely for her, but for her family because why? Common Malay tradition, when visiting your host from afar, it is customary to bring some gifts. It pays to show some social intelligence (Later, I will tell you its importance in my story). NKVE > PLUS > LATAR, one-way journey 110KM to her place at Kuala Selangor. The weather was good and let's see our fate for the day!

Prior to our date, most of the chit-chat in our phone call was trivial questions about ourselves. But that day she shared more about herself than me, mostly about her future career and furthering her Doctoral Degree. One information that strikes me the most is she shared her wedding timeline with me; set in May 2023. It was a good two-hour discussion with her. She also mentioned that she has never gone out on a date before. Well coming from a Universiti Sains Islam Malaysia graduate, I take her word for it. It was a good indicator that I have earned her trust.

We had our first unofficial date at warung and the scenery is surrounded by the lush green paddy fields. Before we part our ways, I jokingly said, "I only know eating rice but never took a photo of a paddy field before" and we have captured our first unofficial date photos. From that point on, our nightly trivial phone conversation becomes our pillow talk session. The topics got a hell of a lot more interesting, as our conversation usually revolves around life after marriage.

Rising Action

» Click to show Spoiler - click again to hide... «

Everything was going swell for our nightly phone pillow talk session. Imagine you compressed 5-months’ worth of the “talking phase”/meeting into whole month of January 2022. That’s how I felt! Because of these intimate and private information, I started to develop pure attachment to her and so does she (I supposed, because she’s the one who initiates the call each night). Until one of those night in January 2022, she reveals an alarming information to me.

She confesses that in the past, she received two rombongan tunang (engagement proposal) from her kampong. I admittedly acknowledge that she is quite pretty, highly educated, stable career and wife material. The criteria of any dudes in kampong to try their luck to get her hand in marriage. I know she has rejected their proposal; if not she would have been someone wife by now. But this story paint a picture in my head, maybe she is highly sought in the kampong area. But then again, kampong people are notorious for spreading shitty remarks “Jual mahal” (very demanding) and now she hasn’t receive any engagement proposal.

Next, she shared that she has many admirers from her classmate during degree to pulis trafik when she has to go through a roadblock. Even though, we haven’t declared anything in our relationship during January 2022. I felt quite jealous because she is being pursued by 9 other guys (10, if you count me in) because I thought our relationship is special since we talk every single night. But after hearing all of my competitors, only one of them that truly give me the hibby jibbies / kick to the balls / knife to the stomach feeling.

From this point out, I’m going to labelled him as Budak C; short for celaka! Quick information why I see him as my ultimate threat. Budak C lives only 20 minutes away from her place compared to me which have to commute 1h30minutes. She has known him the longest since 2019 and consistently communicating with her. Why I felt super threatened by Budak C? During their first meet up this guy so gung ho said he wants to marry her after she completed her degree. (Never dated with him, only like meeting at canteen at her studies). Haiyoo, I guess majority of us guys including myself won’t even dare make that kind of promise during our first meeting. Nonetheless, Budak C has many tactical advantage compared to me.

After she has shared her own experience being approached by guys, everything is back to normal but I still have some reservation about Budak C. Heck! We even planned our first official date on 1st CNY, taking advantage of the public holiday since both of us work with company that took one week off for CNY. Of course I was excited as this is the suitable moment for me to confess my feeling for her.

“Honest Action is overcoming your fear and anxiety around women. Our anxiety is another form in which we highly invest ourselves in others’ perceptions and avoid our truth. If you see a beautiful woman and have a desire to meet her, to not take action and meet her is a form of being dishonest with yourself” – Mark Manson

Two days prior to our first date, she changed up the plan by only going on a lunch date. Again. I didn’t mind as long as I can convey my feelings towards her. On the day itself, I wait her at the petrol pump station and ask her to ride with my car even though she persuade me to ride hers. I knew she wanted to quickly get this day over with. Once, we had our lunch date I purposely missed our turn and drove straight to Teluk Intan to buy me some time. She was complaining at first but later looking forward to it as if it was an adventure.

At Teluk Intan we have some dessert and she starts to talk about our relationship. She said let’s remain as a good friend and focus to support each other for our studies. Let’s limit our nightly call to once a week and going on a “date” once every two months. I was quite puzzled by this because based on what you guys has read so far everything is going according to plan. So, I pried open the truth out of her! Unbeknownst to me, she has reveal about her “friendly” relationship with me to Budak C. So, Budak C has asked her to sent a nuclear bomb to me by limiting her relationship with me!

Truly a celaka move because no sportsmanship at all. Hey bro! Best men win lah, if you cannot level the playing field might as well quit the game. I was pretty black and sour face once I heard the real reason why she wanted to axe everything with me. During the long drive back to her place, she has also shared on 2nd CNY she will go on a “date” with Budak C too. I thought I was the one that dated her. I didn’t have the mood to confess my truest feeling to her but I did manage to wrote a confession letter in advance attached together with our first photo taken at the paddy field last December 2021. No pillow talk phone call session that night.

Afternoon 2nd CNY, I received a call from her inviting me to catch a movie at Kuala Selangor at 2pm. I knew that she supposed to have a “date” with Budak C but I didn’t dare to ask such question to ruined another chance to spend quality time together with her. There I was on 02.02.2022, with two movie ticket at 1:50pm waiting for her to show up to catch a showtime at 2pm. I waited until 2:20pm before I gave her a call, luckily she said stuck on traffic jam due to the calendar date is so nice for wedding/engagement ceremony. When she finally did arrive at 3:30pm an hour later, she only got to see only 20 minutes of the film before it ended.

She felt terrible so we decided to watch the next available movie. It was Nasi Lemak 1.0. Surprisingly, it’s pretty funny and I dare to say that we are the only Malay couple in the cinema hall. 6pm after the movie, I invited her for dinner at a kopitiam before I head back home. She said that the letter that I wrote has really left a mark at her heart and her mom sort of approve me. Remember what I said about social intelligence earlier? On 1st CNY I bought a box of cupcake for her family and I didn’t even know that it was her mom birthday. She acknowledges that she misses going out with me and she readily ditched Budak C that very afternoon to meet me because she felt bored with him. I am in cloud 9 guys!

Need Serious /K Opinion On..

Hi Serious /k, I need your opinion. Next week, NIOSH Certification Sdn Bhd is having a QMS ISO9001:2015 Internal Auditor Certification. It is remote learning for 2 days and cost RM850.

Currently, I work as an super entry level Admin Executive. I have been doing a bit of ISO documentation to apply for CIDB Score and renew my company certification next year. Everything is informal training, majority I seek ISO9001 info from Google. Is it wise taking the above mentioned certification from NIOSH?

Serious /k, what is your professional opinion on this matter. As I am still a freshie, can this cert enhance my employability or I should seek other courses / certification to study more practical skills.

Thanks in advance, semua!

» Click to show Spoiler - click again to hide... «

https://flex.nioshcert.com/training/254
