Call off selling house deal

So currently I am stuck in such a weird predicament.

1. I am seller.
2. Signed an offer to purchase contract for under progress house, enforced by lawyer. 5% earnest deposit paid.
3. Buyer passed away. SPA not signed yet.

Now loyar say there's few options.

a) If buyer called off this deal, I can take the deposit. BUT on goodwill basis, I can return all of it.
b) If buyer beneficiaries were to proceed with this deal, but I want to cancel off the deal, I will get penalized for 5%. Of course, if both side have an agreement to waive it, then no problem.

Is that correct?

Basically what I want to ask is, beneficiary of the buyer still have enough power to enforce the deal even if I wanted to call off the deal. Correct?
